1. Business to Come Before the Board
a. Special Use Permit #2014-02, Buffalo Ridge Center – Review and Action
A public hearing was held on the Buffalo Ridge Center PUD application on July 22, 2014. Following approval of Findings in support of its decision, the Township Board adopted a motion to approve the application, subject to a number of conditions. Some board members had concerns about the project and brought up possible legal conflicts regarding the project and the procedures that were taken in the approval process. Board discussion centered around a second legal opinion and a conflict in the PUD ordinance as written concerning this project.
Schumacher moved THAT Report and Decision Order for Special Use Permit #2014-02, Buffalo Ridge Center, be adopted. Featherstone seconded the motion.
Yeas: Schumacher, Featherstone, Agostinelli
Nays: Schmuckal, Wilson, Blood Law
The motion was defeated due to a tied vote. A second special meeting was decided on for Tuesday, August 5, 2014 at 4pm in the Feiger Room and the differences between the attorney opinions will be worked out by that time.
2. Public Comment
Joe Serafa sympathizes with the decision made at this time by the board. He added that Attorney Doren did speak to staff, did research, and spoke with the other attorney.
3. Adjournment
Schmuckal moved and Featherstone seconded to adjourn the meeting at 5:19pm.
